These Terms of Service ("Terms") govern your use of our website, services, and any related interactions with Kids Castle. By accessing our website or booking our services, you agree to be bound by these Terms. If you do not agree, please refrain from using our services. These Terms are intended for customers based in New Zealand and comply with applicable New Zealand laws and regulations.
Kids Castle provides inflatable rentals and event services designed to enhance family-friendly events. These include, but are not limited to:
Rental of inflatable equipment (e.g., bouncy castles, slides).
Delivery, setup, and takedown of equipment.
Event-related support services where applicable.
We reserve the right to modify our services at any time without prior notice, provided such modifications do not materially affect confirmed bookings.
Booking Process:
Bookings can be made via our website, phone, or email.
A booking is confirmed only upon receipt of a completed booking form and payment of any required deposit.
Payment Terms:
Full payment must be received no later than 24 hours after the event date.
Accepted payment methods include bank transfer and cash.
Deposits and Cancellations:
Cancellations made more than 1 day before the event will receive a full refund.
Force Majeure:
We are not liable for cancellations due to circumstances beyond our control, including extreme weather, natural disasters, or government restrictions.
Supervision:
Customers must ensure responsible adult supervision of children using our equipment at all times.
Supervisors must enforce the safety rules provided by Kids Castle staff.
Site Requirements:
The setup area must be flat, free of debris, and easily accessible for our delivery team.
In the event that the site is deemed unsuitable upon arrival, Kids Castle reserves the right to cancel the service without refund.
Safety Guidelines:
Users must adhere to weight and age restrictions.
Food, beverages, sharp objects, and footwear are prohibited on the inflatables.
Equipment must not be relocated or used inappropriately.
Inflatables are for children only unless explicitly stated otherwise.
Climbing, hanging, or sitting on walls and netting is prohibited.
Condition of Equipment:
Kids Castle ensures that all equipment is delivered in clean and safe condition.
Customers must inspect the equipment upon delivery and report any defects immediately.
Damage to Equipment:
Customers are responsible for any damages caused by misuse, negligence, or failure to follow safety instructions.
Repair or replacement costs for damaged equipment will be charged to the customer.
Cleaning fees of up to $100 may apply for excessive dirt or stains. Repairs for minor damages may incur charges of up to $500, and irreparable damage may require full replacement costs, up to $2,000.
Liability Disclaimer:
Kids Castle is not liable for injuries, damages, or losses resulting from improper use of our equipment or failure to follow safety guidelines.
Customers assume all risks, including but not limited to physical injury or property damage, associated with the use of the equipment.
Your use of our services is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By booking our services, you consent to the terms of the Privacy Policy.
Ownership:
All content on our website, including text, images, logos, and trademarks, is the intellectual property of Kids Castle and protected under New Zealand copyright laws.
Restrictions:
Customers may not copy, reproduce, or use any content for commercial purposes without prior written consent.
Customers agree to indemnify and hold harmless Kids Castle, its employees, and affiliates from any claims, liabilities, damages, or costs arising from:
Breach of these Terms.
Misuse of equipment.
Injuries or damages occurring during the event, except where caused by gross negligence or willful misconduct by Kids Castle.
Theft, loss, or destruction of the equipment during the rental period.
By Kids Castle:
We reserve the right to terminate services at our discretion, including for violations of these Terms or unsafe conditions at the event site.
By Customer:
Customers may cancel bookings in accordance with our cancellation policy.
Governing Law:
These Terms are governed by the laws of New Zealand.
Resolution Process:
Any disputes must first be addressed through good-faith negotiation.
If unresolved, disputes may be escalated to mediation or arbitration under New Zealand law.
We reserve the right to update these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services indicates acceptance of the revised Terms.
